Film Censorship in India: The Law and Beyond

 

This talk discusses censorship in Indian cinema and the scope for reforming the existing system, with an emphasis on political speech. At first, a critique is offered of traditional legal definitions of censorship, which only focus on prior legal restraints imposed by the state. It is rather argued that censorship can be imposed by non-state actors, can involve “extra-legal” methods, can occur after the dissemination of speech, and can also be self-imposed.

Tracing the history of political censorship in Indian cinema, the author argues that much of the censorship in India has been in breach of judicial guidelines, and has seriously inhibited free speech.

Arpan Banerjee is Assistant Professor and Assistant Dean at Jindal Global Law School, India. At Jindal, Arpan teaches Intellectual Property Law and Media and Entertainment Law, and heads a research centre focusing on these areas. Arpan is currently based at Bucerius Law School as a recipient of the Alexander von Humboldt Foundation German Chancellor’s Fellowship.
